European criminal defence: your lawyer in Spain for cases in the EU
My clients live their lives split between two countries — and so do their criminal problems. That is why my practice does not end at the border: with the European lawyer's card and the Union's criminal cooperation instruments, I handle from Spain cases happening in any EU country. These are the services.
The European lawyer's card: what it allows me
The European card certifies before courts, prisons and authorities across the EU that I am a lawyer admitted in a member State, and European rules allow me to act in other Union countries under my Spanish title. The limit, stated plainly: procedural acts before another country's courts are carried out in conjunction with a local lawyer. My role is to direct the defence from Spain — the strategy, the file, the contact with you in your language — with local correspondents for the signature there.
Visiting your client in prison in any EU country
For a family here with a relative detained in another country, the distance is the worst part. The European card accredits me as a lawyer to access prisons of other Union States — under each centre's rules —: I can visit my client there, verify his situation and be the family's eyes and voice inside.
Transfer of sentenced persons to Spain
The flagship service has its own page: bringing a prisoner from another EU country to serve his sentence in Spain, close to his family — mutual recognition, roots dossier and follow-up until the physical transfer.
Serving probation at home — and awaiting trial at home
Two siblings of the transfer that almost nobody knows. If the sentence in another country is suspended or on probation, supervision can be transferred to Spain: the client returns and fulfils his obligations here (Framework Decision 2008/947/JHA). And someone awaiting trial in another State can, instead of suffering pre-trial detention there, await trial in Spain under supervision measures (Framework Decision 2009/829/JHA). Awaiting trial at home, not in a foreign prison: for families, few things matter more.
European arrest warrant: defence in both directions
I handle extraditions and European arrest warrants before the Audiencia Nacional. European criminal defence closes the circle: when a client is wanted by another State — or when Spain seeks someone detained abroad —, the game is played on two boards at once, and I coordinate the overall strategy with the lawyer in the other country: what is argued here, what is argued there, and in what order.
Detained in another country: coordinated defence
If your relative is detained in another EU State, the family should not have to fight a foreign judicial system in a language they do not speak. I take care of it from Spain: I engage a local lawyer, supervise the defence strategy, travel when the case requires it and remain the permanent bridge with the family — in English, directly with me.
Fines and criminal records that cross borders
European criminal cooperation also reaches the small things: criminal penalties from another country enforced in Spain — which can often be challenged here —, and criminal records circulating between States through the ECRIS system, affecting residence permits, work or new cases. Before paying or giving up, ask.
